Co-Counsel Pty Ltd ACN 643 382 236 (Co-Counsel) respects your privacy and we are committed to protecting your personal information. Our Privacy Policy applies to all personal information collected by us, or submitted to us, including personal information collected or submitted through our website.

This Privacy Policy describes how we deal with information we collect. By visiting our Site and providing personal information to us, you accept and consent to the practices described in this Privacy Policy. If you do not agree with any of the terms of this Privacy Policy, please do not use our Site or submit any personal information to us.

Please note that providing your personal information is voluntary. However, if you do not provide us with the personal information we reasonably require, we may not be able to perform our functions, or provide you with some or all of our products and services.

Types of personal information we may collect.

In this Privacy Policy, personal information has the meaning given to it in the Privacy Act 1988 (Cth), and includes information or an opinion, whether true or not, about an identified individual or an individual who is reasonably identifiable.

Personal information we may collect and hold includes your name, date of birth, occupation, company name, office address, phone number, email address, payment details, employment history, education, qualifications, and any other information which assists us in conducting our business, providing and marketing our services and meeting our legal obligations. In some cases, we may also collect ‘sensitive information’, such as information about an individual’s membership of a professional association or health information.

We may also collect and process non-personal information provided to us by your browser when you visit our websites or use our applications, for example, the website you came from, your location information, IP address, web browser, device type and the time and date of access.

How we collect personal information.

We collect personal information from you directly when you provide your details to us, or from you indirectly through emails, online queries and telephone conversations, and through use of the services available through our Sites.

Why we may disclose personal information.

We may disclose your personal information  to third parties who assist us in providing our services, and where we are required or authorised to do so by law.

For the purposes of applicable data protection laws, Co-Counsel is the data controller of the Site. If you are a resident in the European Economic Area, you have the following rights in relation to your personal information (where applicable):

  • the right to request a copy of the personal information we are processing about you. For your own privacy and security, at our discretion we may require you to prove your identity before providing the requested information
  • the right to have incomplete or inaccurate personal information that we process about you corrected
  • the right to request that we delete personal information that we process about you, except we are not obliged to do so if we need to retain such data in order to comply with a legal obligation or to establish, exercise or defend legal claims
  • the right to restrict our processing of your personal information where you believe such data to be inaccurate; our processing is unlawful; or that we no longer need to process such data for a particular purpose unless we are not able to delete the data due to a legal or other obligation or because you do not wish for us to delete it
  • the right to obtain personal information we hold about you, in a structured, electronic format, and to transmit such data to another data controller, where this is (a) personal information which you have provided to us, and (b) if we are processing that data on the basis of your consent or to perform a contract with you
  • the right to object to processing of your personal information (where the legal justification for our processing of your personal information is our legitimate interest) on grounds relating to your particular situation. We will abide by your request unless we have compelling legitimate grounds for the processing which override your interests and rights, or if we need to continue to process the data for the establishment, exercise or defence of a legal claim
  • the right to withdraw your consent at any time (where you have previously consented to our processing of your personal information) free of charge. This includes where you want to opt out from marketing messages that you receive from us.

How long we keep personal information.

We will only retain your personal information for as long as is necessary for the purpose for which that personal information was collected and to the extent permitted by applicable laws. When we no longer need to use personal information, we will remove it from our systems and records or take steps to anonymise it so you can no longer be identified from it.

Access to and correction of personal information.

Subject to the exceptions set out in the Privacy Act, you may seek access to and correction of the personal information which we hold about you.  We will require you to verify your identity and to specify what information you require.  Please contact our Privacy Officer at info@cocounsel.com.au.

Privacy complaints.

If you would like any further information about our handling of personal information or to make a complaint about our handling of your personal information, please email your complaint to our Privacy Officer at info@cocounsel.com.au. Once we receive your complaint, we will respond to you within a reasonable period of time, usually within 20 working days. Updates to our Privacy Policy.
